Tomic had been celebrating his 20th birthday when neighbors noticed the fracas about 5:30 a.m. on Monday. Police were called and told one man was trying to strangle another.

“It was a bit of a wrestle and laugh around that came out the wrong way,” Tomic told Australia’s *Channel 9*. “It’s not their (the police) fault. They didn’t know who was up there, or what was going on -- they just wanted to come check and found it was me. I know I am having a bad year but they’re my problems I have to deal with and I am hopeful I can have a better year next year.”

Tomic apologized to anyone who was offended.
